Terms and Conditions

1. Acceptance of Terms

By accessing and using the Visary mobile application ("App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the App for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained in the App
• Remove any copyright or other proprietary notations from the materials

3. In-App Purchases

The App may offer in-app purchases ("IAP") for premium features, subscriptions, or content. By making an in-app purchase, you agree to the following:

• Payment: All in-app purchases are processed through your device's app store (Apple App Store or Google Play Store). Payment will be charged to your account at confirmation of purchase.
• Subscriptions: If you purchase a subscription, it will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Refunds: Refund requests must be made through your app store's refund policy. We do not process refunds directly.
• Cancellation: You can cancel your subscription at any time through your device's app store settings.
• Price Changes: We reserve the right to change subscription prices at any time.
• Free Trials: If you start a free trial, you will be charged when the trial period ends unless you cancel before the trial expires.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content

You retain ownership of any content you submit, post, or display on or through the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your User Content solely for the purpose of providing and improving the App.

You are solely responsible for your User Content and agree not to submit content that is illegal, harmful, or violates any third-party rights.

6. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

7. Disclaimer

The materials in the App are provided on an 'as is' basis. Visary makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

The App provides information and tools to help you track visa applications, but we do not guarantee the accuracy of visa requirements, processing times, or outcomes. You should always verify information with official government sources.

8. Finding a Solicitor or Immigration Adviser

Visary lets you request quotes from, and contact, independent law firms and regulated immigration advisers ("Firms") through the Marketplace and the Approved Network. By using these features you agree to the following:

• Visary is not a law firm. We do not give legal or immigration advice and are not responsible for the advice or services a Firm provides. Your legal relationship is with the Firm you instruct, under its own client care letter and terms.
• Sharing your matter. When you submit a matter, we share the details you provide (such as visa type, circumstances, urgency and document status) with Firms on Visary so they can decide whether to quote. Your contact details and documents are only released to a Firm once you select it or contact it directly.
• Paying a Firm through the Marketplace. When you accept a Quote, you pay the Firm's quoted fee through Visary. We hold your payment through our payment provider and release it to the Firm only once the Firm has submitted your application and we have confirmed the submission reference. If your matter ends before submission, your payment is refunded, less any amount you and the Firm agree is due for work already done. Government fees (such as Home Office fees and the Immigration Health Surcharge) are paid separately unless your Quote says otherwise.
• How Visary is paid. Using the Marketplace is free for you. Visary keeps 10% of the Firm's quoted fee as a platform fee and pays the rest to the Firm. This comes out of the price the Firm quoted, not on top of it. Firms in the Approved Network pay Visary an annual listing fee instead, and you deal with them directly.
• Your choice. You are free to choose any Firm, or none, and to seek advice outside Visary. Quotes are set by each Firm, and we do not rank Firms by the fees they pay us.
• Checks and regulation. We check Firms' regulatory status when they join, but you should confirm a Firm's registration with the Solicitors Regulation Authority or the Immigration Advice Authority before instructing it. No Firm can guarantee a visa outcome.
• Complaints. Complaints about a Firm's service should go to the Firm first, then to the Legal Ombudsman or the Immigration Advice Authority as applicable. Please also tell us so we can review the Firm's listing.
• Accurate information. You must provide truthful information and genuine documents. Firms rely on what you provide to advise you.

9. Limitations

In no event shall Visary or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if Visary or a Visary authorized representative has been notified orally or in writing of the possibility of such damage.

10. Accuracy of Materials

The materials appearing in the App could include technical, typographical, or photographic errors. Visary does not warrant that any of the materials on its App are accurate, complete, or current. Visary may make changes to the materials contained in the App at any time without notice.

11. Modifications

Visary may revise these terms of service for its App at any time without notice. By using this App you are agreeing to be bound by the then current version of these terms of service.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
